Terms of Service
1. What this is
vitalinguist (the “Service”) is a language-learning app and web site operated by Vitaly Zubkov (“we”, “us”). By creating an account or using the Service you agree to these Terms.
If you disagree with anything here, don't use the Service. If a specific clause is unenforceable in your jurisdiction, treat that clause as replaced with the closest enforceable equivalent; the rest of the Terms still apply.
2. Your account
- You need to be at least 13 years old. If you're between 13 and 18 (or your local age of majority), you're using the Service with your parent or guardian's permission.
- You'll give us an accurate email so we can log you in. If it changes, update it in Profile.
- Keep your login safe. You're responsible for anything done under your account until you tell us to close it.
- One person per account. Don't share it.
3. What you can do
- Practice a language for personal, non-commercial use.
- Post progress reports and comment on other students' reports as configured.
- Recite phrases into the microphone, record short session videos, and let the AI help you.
4. What you can't do
- Reverse-engineer the app, extract the models, or scrape the site.
- Use the Service to generate content you'll pass off as your own for academic grading or other cheating.
- Send hate speech, illegal content, or attempted-abuse traffic through the Trainer or Reports.
- Try to identify or contact other students outside the features the app provides for it.
- Automate use (bots, scripts) beyond what our documented endpoints support.
Violations can lead to account suspension or termination.
5. Your content
- You keep ownership of anything you write, record, or upload.
- You grant us a limited licence to store your content, process it to run the Service (transcribe your voice, generate Trainer replies), and show it back to you in your account.
- Reports you post publicly grant us and other students in your context a read licence for as long as the post remains public.
- We don't sell your content.
6. AI-generated content
The Trainer's replies are generated by large language models. They can be wrong, out of date, or stylistically off. Don't rely on the Trainer for authoritative language advice — treat it as a patient practice partner, not a certified teacher.
7. Payment (when it applies)
- The Service is currently free.
- If we introduce paid tiers or subscriptions in future we'll notify you at least 30 days in advance, and paid features will be opt-in — your current free access won't be pulled without notice.
- If you're charged for anything, refunds are handled by the store you bought through (App Store, Play Store) subject to their rules; you should contact them first.
8. Availability
We do our best to keep the Service up but we don't guarantee uptime. Sometimes things break; sometimes we do maintenance. If there's an incident that loses your data (which we work hard to prevent), we'll email you.
9. Third-party services
The Trainer uses LLM providers (Anthropic, Groq, OpenRouter) to generate replies. Push notifications go through Firebase Cloud Messaging. Their terms apply to their portion of the pipeline; ours cover only what we operate. See the Privacy Policy for exactly what data touches which third party.
10. Termination
- You can delete your account any time from Settings.
- We can suspend or terminate an account that violates section 4, that our hosting or payment providers require us to close, or that has been dormant for 24 months.
- On termination we'll purge your data as described in the Privacy Policy.
11. Warranty and liability
The Service is provided “as is” without warranty of any kind, express or implied, to the maximum extent permitted by law. Our aggregate liability to you for anything relating to the Service is limited to the amount you paid us in the last 12 months (which, for the free tier, is zero).
Nothing in these Terms excludes liability we can't legally exclude — like death, personal injury caused by our negligence, or intentional wrongdoing.
12. Changes
If we update these Terms materially (new rules on what you can do, new liability terms, price introduction), we'll notify you via email and in-app at least 30 days before it takes effect. Continuing to use the Service after that means you accepted the new Terms. Minor updates (typos, contact info, non-material clarifications) can happen without notice.
13. Governing law and disputes
- These Terms are governed by Spanish law (place of business: Madrid, Spain).
- Disputes go first to us via support@vitalinguist.com — most things are solvable in an email or two.
- If that fails, the courts of Madrid have exclusive jurisdiction, unless the mandatory consumer-protection law of the country where you live gives you a right to sue at home; in that case, that right applies.
